LONDONDERRY — A Londonderry woman who says she fell at the Stumble Inn three years ago has filed a lawsuit against the bar and grill as well as its landlord B-Saini Group LLC in Rockingham County Superior Court.
According to court documents, Brittany Pescia visited the Stumble Inn at 20 Rockingham Road, which does business as 20 Rock LLC, on April 8, 2016, around 9 p.m.
As she began to walk toward the entrance, two unnamed men were exiting and engaged in a fight, the suit alleges.
According to the complaint, the entrance was too narrow to allow Pescia and the brawling men to enter and exit at the same time.
Pescia says she was pushed, lost her balance and fell, according to the lawsuit.
According to court documents, Pescia was injured, receiving a cerebral concussion, mild traumatic brain injury, post-concussion syndrome and a spinal injury.
Pescia lost wages as a result of being injured, according to the complaint.
The lawsuit alleges the Stumble Inn and the B-Saini Group were negligent when they failed to warn customers about the narrow entrance.
According to the suit, the bar and the property owner failed to warn customers of the "hazardous condition" with visual cues, failed to construct a handrail or ramp, and violated building safety codes and standards.
The lawsuit also alleges the Stumble Inn served alcohol negligently.
Pescia's lawyer Andrew Myers did not return calls for comment by press time.
Calls to the Stumble Inn for comment were not returned.
