DERRY — Anthony Daylor was in an apartment with David Frediani, the man he is accused of shooting, before stepping outside and firing several rounds at Frediani through a window Tuesday night, police said.

"These people knew each other. They were not strangers," Derry police Capt. Vernon Thomas said yesterday. "This was not a drive-by shooting or a stranger shooting another."

Daylor, 19, of 55 Welcome St. in Haverhill, Mass., is expected to be arraigned Thursday in Derry District Court on one count of first-degree assault.

The charge is a class A felony that carries a potential prison term of seven and a half to 15 years.

Thomas said Frediani lives in the apartment building at 28 Elm St., where the shooting occurred. He has friends who live in other apartments in the building, police said. The group had been going back and forth between the apartments Tuesday before an argument between Frediani and Daylor prompted the two to part ways, police said.

Thomas said yesterday investigators have a theory about what the argument was about, but he declined to elaborate saying it would be inappropriate to speculate.

Frediani was struck in the hip by a single bullet and was listed in stable condition yesterday at Parkland Medical Center.

The shooting happened around 8 p.m. Tuesday, just moments after witnesses said Frediani and several others were seen and heard arguing outside the building, police said.

Police tracked Daylor down Wednesday morning at an apartment in Manchester after receiving information that he might be there.

Witnesses were able to give police a description of Daylor and a gold 1994 Lincoln Continental that drove away from the scene. Police found the car later Tuesday night.

Manchester police found Daylor at the apartment yesterday around 11 a.m., and took him into custody without incident.

Police records show Frediani was arrested in November 2007 by Derry police on charges of theft of services and driving after his license had been suspended.

Daylor was taken into custody by Derry police late yesterday afternoon. He was expected to be held overnight and questioned by investigators prior to his arraignment today.

Thomas said investigators are still pursuing several leads in the case, and it remains to be seen whether anyone else will be charged in the shooting.
