Londonderry Town Manager Dave Caron said today that the town has learned that Rockingham County Superior Court ruled on Jan. 14 that a proposed citizen's petition asking that conservation funds be used to build a replacement north/west fire station is "void, illegal and unenforceable."
The Town Council had filed a motion for summary judgment last fall after receiving advice from the town attorney that the action requested in the petition was in violation of state statutes.
The court did not, however, act on the town's request not to place the petition on the Town Meeting warrant. That means the petition article will still appear as an article at the March 15 Town Meeting.
